Yes, a silicosis lawyer can help you evaluate a claim if dust from cutting, grinding, drilling, or polishing stone countertops caused your silicosis. Yes, a silicosis lawyer can help you bring a claim if silica dust released while cutting, grinding, drilling, polishing, or modifying stone countertops caused your silicosis. Workers' compensation may not be the only available claim because the companies that made and sold the engineered stone slabs can be separate responsible parties. Seek evaluation from a qualified medical professional, preserve your countertop-fabrication work history and any information about the slab brands you handled, and obtain a legal review promptly because California and Oregon apply different filing deadlines.
How a Silicosis Lawyer Handles a Countertop-Fabrication Case in California and Oregon
Silicosis is an incurable occupational lung disease caused by breathing respirable crystalline silica. In countertop shops, dangerous dust is released when workers cut, grind, drill, shape, or polish engineered stone, quartz slabs, granite, and other silica-containing countertop materials. The particles are too small to see and may remain airborne, so workers can inhale them without realizing it. Doctors often diagnose the disease only after permanent lung scarring has developed.
A silicosis lawyer builds the claim on two central facts. First, medical evidence supports a diagnosis of silicosis tied to respirable crystalline silica exposure. Second, the worker's fabrication history identifies the countertop products, slab brands, shops, and tasks associated with that exposure. Product identification matters because it can point to the companies that designed, manufactured, imported, distributed, or sold the engineered stone slabs.
Workers' compensation is usually the exclusive remedy against the worker's own employer. However, it generally does not prevent a separate civil claim against third parties, potentially including companies that designed, manufactured, imported, distributed, or sold engineered stone countertop slabs. The workers' compensation claim may address medical care and disability benefits, while a product-liability case may seek damages unavailable through workers' compensation, including pain and suffering.
Because the claims can affect each other, the civil attorney should account for any workers' compensation claim and coordinate with separate workers' compensation counsel when appropriate.
First, Jaime reviews your diagnosis and countertop-fabrication work history for free. If he takes the case, he identifies every shop where you fabricated countertops, the tasks you performed, and every slab brand you can remember. He then preserves the medical records and exposure evidence and pursues claims against the responsible product companies. Because you work directly with the attorney, you know where your case stands.
Who Gets Silicosis from Stone Countertop Fabrication?
Stone countertop fabricators are at the center of this wave of disease. They cut engineered stone and quartz slabs to size and then grind, drill, shape, and polish them in a shop or at an installation site. Engineered stone can contain more than 90 percent crystalline silica. Natural granite generally contains less, and marble far less. Cutting these materials can release respirable crystalline silica, often called RCS.
California public-health investigators have identified clusters of severe disease among countertop workers, many of them young Latino men. Oregon OSHA has likewise identified artificial-stone countertop fabrication as an emerging hazard associated with recent outbreaks of severe accelerated silicosis in young workers.
Within the kitchen-countertop industry, exposure can happen while:
- Cutting engineered stone, artificial stone, quartz, or granite slabs
- Operating bridge saws, CNC machines, or handheld cutting tools
- Grinding, shaping, or polishing countertop edges and seams
- Drilling faucet holes or making sink and cooktop cutouts
- Performing onsite cutting or modification during installation
- Cleaning dust, slurry, or debris created by fabrication work
- Working nearby as a shop helper or other fabrication employee
What Is My Silicosis Case Worth?
Every case is different, so no honest silicosis lawyer can promise a number. Still, the categories of compensation in silicosis lawsuits are well settled. First, there are medical costs, from imaging and pulmonary care to oxygen, medication, and a transplant evaluation. Second, there are lost wages and lost earning capacity. For a fabricator in his thirties who can no longer work, that piece is often the largest. Third, there is money for pain and suffering, disfigurement, and the loss of the life you had. In addition, a spouse may have a claim for loss of consortium.
Several facts push a claim's value up. For example, a young worker with an accelerated form of the disease faces decades of lost earnings and care. A worker on a transplant list faces huge future medical costs. Meanwhile, proof that a company knew the danger and sold the product anyway can support punitive damages. Those damages punish the conduct instead of repaying a bill. Because of that, the discovery phase in these cases matters enormously, and a silicosis lawyer should press it hard.
If silicosis took a family member, the family can bring a wrongful death claim under California Code of Civil Procedure section 377.60. Our wrongful death lawyer page explains who may file and what that claim covers.
Be careful with early offers. Courts now group many silica claims into coordinated litigation. Defendants sometimes float a quick, low number to close a file before the medical picture is clear. Once you sign a release, you cannot come back later when your breathing gets worse. However, a silicosis lawyer can review any offer for free and tell you whether it matches what is actually ahead of you.
The cost to you is simple. Madrigal Law handles silicosis claims on contingency. That means nothing up front, no hourly bills, and no fee unless Jaime wins. The consultation is free. As a result, hiring a silicosis lawyer does not depend on what is in your bank account today.

California Silica Law You Should Know
California regulates respirable crystalline silica harder than almost any other state. Cal/OSHA's standard sits in title 8 of the California Code of Regulations, section 5204. It sets a permissible exposure limit of 50 micrograms per cubic meter of air over an eight-hour shift, with an action level of 25. It also tells employers to control dust with water or ventilation, to supply respirators where those controls fall short, and to offer medical surveillance to exposed workers. In addition, Cal/OSHA adopted an emergency temporary standard aimed squarely at engineered stone fabrication after the wave of cases among countertop workers. That standard tightened controls and enforcement for the trade.
Those rules matter to your claim in a direct way. Maybe the shop dry-cut slabs with no water. Maybe it ran no local exhaust ventilation, handed out paper dust masks instead of fitted respirators, or skipped the medical checks. Each of those failures is evidence of negligence. Because the standard is written down, a jury can see the gap between what the law required and what the shop actually did.
The claims against the manufacturers rest on product liability law. California applies strict liability to defective products, so the focus falls on the product itself. Two theories drive silica cases. The first is design. A slab that runs more than 90 percent crystalline silica creates a severe and foreseeable hazard once a worker cuts it, and safer alternative designs exist. The second is failure to warn. The makers and distributors knew what respirable silica does to lungs. Even so, the warnings that reached the shop floor were weak, buried, or missing, and rarely in Spanish. Our product liability lawyer page explains how these defect theories work in general.
Two more rules deserve attention. First, California follows pure comparative fault. Your share of the blame can reduce a recovery, but it does not bar one. That rule matters, because these defendants love to argue that the worker chose not to wear a mask. Second, California Code of Civil Procedure section 335.1 gives you two years for a personal injury claim. However, latent occupational disease claims run on the discovery rule. The clock generally starts when you knew, or should have known, both that you were sick and that work caused it. Reasonable people argue about that date. Workers' compensation claims also carry their own separate and shorter deadlines. So the safest step is simple. Let a silicosis lawyer check the timeline early instead of assuming you still have time.
One more point, and it is important. Your immigration status does not bar you from recovering for a workplace injury in California. State law protects all workers regardless of status, and a defendant is not entitled to use it against you. Many of the workers in this litigation are immigrants, and fear of speaking up is part of why the exposure went unchecked for so long.
Why Choose Attorney Jaime Madrigal
When you hire Madrigal Law, you get the attorney, not a case manager. Jaime Madrigal answers the phone, builds your case, and stays your point of contact from the first call to the last. Because he handles every case personally, you get straight answers from the person actually doing the work. When you look for a silicosis lawyer, ask who will really handle the file, and ask whether you will ever speak with them again after you sign.
Silicosis litigation is not a new subject for him. Before founding Madrigal Law, PC, his experience covered personal injury, wrongful death, premises liability, motor vehicle collisions, nursing home cases, and silicosis litigation. In fact, he has helped recover millions for injured clients over the course of his career. He earned his law degree cum laude from Willamette University College of Law. He is licensed in both California and Oregon. He also belongs to the Oregon Trial Lawyers Association and the American Association for Justice.
He speaks fluent Spanish, and that is no small detail here. Most of the fabricators getting sick in California speak Spanish. The warnings they were handed usually did not. Moreover, the medical and work history that proves a claim has to come out in the language the worker actually lives in. Jaime takes that history himself.
Madrigal Law is remote and mobile. He comes to you by phone, text, video, or in person. If you are on oxygen or recovering, you do not need to travel to an office. Cases filed in Kern County go to the Kern County Superior Court on Truxtun Avenue in downtown Bakersfield. He prepares every case as though it will be tried there.
